2.4.1.2.Scope of the Foreign Labour Act


In principle, the AuslBG applies to all persons not in possession of Austrian citizenship, with the exception of foreigners from EU and EEA countries, their spouses and children, relatives of Austrian nationals (spouses and children aged under 21) who are not themselves Austrian citizens, refugees under the Geneva Convention and persons who are employed in Austria on the basis of intergovernmental or international treaties or are engaged in specific activities which require no official approval (foreign correspondents, academics, diplomats, etc.).

The following are the primary circumstances in which approval is required for the use of foreign labour: under employment, training or similar contracts as well as employment of workers delegated by their foreign employers and of shareholders who have no significant say in the management of the company.
